NJ MedicaidCHANGES IN MEDICAID LAW

The DRA (Deficit Reduction Act of 2005) has not been officially ratified by NJ.

In the absence of the new formal regulations, Trenton appears to be honoring certain aspects of the DRA.

The lookback period has been changed from 3 to 5 years (36 mo. to 60 mo.). Even so, there are still numerous exceptions the new lookback rule that NJ is still honoring.

The documentation needed to implement such exceptions has changed and has become more involved. Because laws differ from state to state, you may need to engage the services of a Medicaid lawyer in your area.
