Pre-nuptial
agreements generally define property rights for two individuals
entering into a marriage. Such a contract usually addresses the
following issues:
a) the status
of property each individual brought into a marriage.
b) the status
of property that the husband and/or wife acquires individually or
jointly during the marriage.
c) issues of
support and alimony, where applicable, should the marriage become
dissolved.
d) the ability
of one spouse to leave all, something or nothing to the other in a
Will or other testamentary instrument.
NOTE WELL: An
individual's Will CANNOT supersede the terms of a bona fide
Pre-Nuptial Agreement without the consent of the other party.
